1. Acceptance of Terms

Welcome to Ask Better ("the App"), developed and operated by Believe PR, owned by Armando Jimenez. By downloading, installing, accessing, or using the App, you ("User," "you," or "your") agree to be bound by these Terms and Conditions ("Terms").

These Terms constitute a legally binding agreement between you and Believe PR. By using the App, you represent that:

2. App Description

2.1 Purpose

Ask Better is an empowering questions app designed to help users:

• Practice daily empowering questions across 21 categories
• Generate personalized questions using AI
• Create and manage custom questions
• Build a personal library of favorites and mixes
• Customize their experience with themes and reminders

2.2 Free App

Ask Better is a completely free application:

• No in-app purchases
• No subscriptions
• No advertisements
• All features available to all users

2.3 Availability

• The App is available for iOS and Android devices
• Available in English and Spanish
• Certain features may vary by platform
• We reserve the right to modify or discontinue features at any time

3. License to Use

3.1 License Grant

Subject to your compliance with these Terms, Believe PR grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on devices you own or control
• Access and use the App for personal, non-commercial purposes
• Use all features and functionalities as intended

3.2 License Restrictions

You may NOT:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove or modify any copyright, trademark, or proprietary notices
• Rent, lease, lend, sell, or sublicense the App
• Use the App for any commercial purpose without written permission
• Circumvent any security features or access restrictions
• Use automated tools to access or interact with the App

3.3 Ownership

The App and all intellectual property rights remain the exclusive property of Believe PR and Armando Jimenez. This license does not grant you any ownership rights.

4. User-Generated Content

4.1 Custom Questions

The App allows you to create custom questions. You retain full ownership of your custom content:

• Your custom questions are stored locally on your device
• We never access, copy, or transmit your custom content
• You are solely responsible for the content you create

4.2 Responsibility for Content

You agree that any custom questions you create:

• Do not violate any applicable laws
• Do not infringe on third-party intellectual property rights
• Are created at your own discretion and responsibility

4.3 Data Loss

Since all user content is stored locally:

• Deleting the app permanently removes all your content
• We cannot recover lost data as we never had access to it
• You are responsible for any backups of your content

5. AI-Generated Content

5.1 How AI Generation Works

The App uses Google Gemini (via Firebase AI Logic SDK) to generate questions based on your prompts. You understand that:

• AI-generated content is created algorithmically and may vary in quality
• Generated questions are not reviewed or endorsed by the developer
• There is a daily limit on AI generation requests
• The AI feature requires an internet connection

5.2 Disclaimer of AI Content

5.3 Ownership of AI-Generated Content

AI-generated questions that you choose to save become part of your local library. We make no claim of ownership over AI-generated content saved to your device.

• Not taken directly from any published work by Noah St. John

The questions in this app are for personal growth and self-reflection purposes only. They are NOT:

• Medical or mental health advice
• A substitute for therapy or professional counseling
• Guaranteed to produce specific results
• Scientifically validated treatments

7. Intellectual Property

7.1 App Ownership

All intellectual property rights in and to the App, including but not limited to:

• Source code and software
• User interface and design
• Graphics, logos, and icons
• Curated question content
• Category organization and curation

7.2 Third-Party Trademarks

"Afformations" is a registered trademark of Noah St. John. All other trademarks, service marks, and trade names used in the App are the property of their respective owners.

7.3 User Content Ownership

You retain ownership of:

• Custom questions you create
• Custom themes and settings
• Personal mixes and collections

Since this data is stored locally on your device and never transmitted to our servers, we claim no ownership or rights to your content.

8. Prohibited Uses

You agree NOT to use the App for:

8.1 Unauthorized Access

• Hacking or cracking the App
• Bypassing security measures or access restrictions
• Reverse engineering the App code
• Accessing restricted features without authorization

8.2 Commercial Exploitation

• Reselling or redistributing the App
• Using the App as part of a commercial service without permission
• Republishing curated question content
• Scraping or extracting App content

8.3 Harmful Activities

• Uploading malware or viruses
• Disrupting App functionality
• Abusing the AI generation feature (excessive requests, harmful prompts)
• Attempting to overload or crash servers

9. Disclaimers

9.1 "AS IS" and "AS AVAILABLE"

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY
• UNINTERRUPTED OR ERROR-FREE OPERATION

9.2 No Guarantee of Results

WE DO NOT WARRANT THAT:

• Using the app will produce any specific results
• AI-generated content will meet your expectations
• All features will function perfectly at all times
• The App will be compatible with all devices

9.3 Not Professional Advice

THE APP DOES NOT PROVIDE:

• Medical or mental health advice
• Psychological counseling or therapy
• Professional coaching or consulting
• Guaranteed self-improvement outcomes

9.4 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of implied warranties. In such jurisdictions, the above exclusions may not apply to you, and you may have additional rights.

10. Limitation of Liability

10.1 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BELIEVE PR, ARMANDO JIMENEZ, OR THEIR AFFILIATES BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• LOSS OF DATA OR INFORMATION
• PERSONAL INJURY OR EMOTIONAL DISTRESS
• ANY DAMAGES ARISING FROM USE OF AI-GENERATED CONTENT

10.2 Cap on Liability

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED $50 USD (or equivalent in your local currency).

10.3 Basis of the Bargain

These limitations reflect the allocation of risk between the parties. The App is offered for free, and the limitations are an essential basis of the agreement.

10.4 Jurisdictional Exceptions

Some jurisdictions do not allow limitations on liability for certain types of damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

11. Termination

11.1 Termination by You

You may terminate this agreement at any time by:

• Uninstalling the App from all devices
• Deleting all saved data
• Ceasing all use of the App

11.2 Termination by Us

We reserve the right to:

• Discontinue the App at any time
• Remove the App from app stores
• Disable features or functionality
• Restrict access to AI generation services

11.3 Effect of Termination

Upon termination:

• Your license to use the App immediately ends
• You must cease all use of the App
• Provisions regarding disclaimers, liability, and indemnification survive

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Puerto Rico, without regard to its conflict of law provisions.

12.2 Jurisdiction

You agree that any legal action or proceeding arising from these Terms shall be brought exclusively in the courts of Puerto Rico, and you consent to the jurisdiction of such courts.

12.3 Dispute Resolution

Before filing any legal action, you agree to attempt to resolve disputes through:
