1. Acceptance of Terms

Welcome to Devotion ("the App"), developed and operated by Believe PR, owned by Armando Jimenez. By downloading, installing, accessing, or using the App, you ("User," "you," or "your") agree to be bound by these Terms and Conditions ("Terms").

1.1 Agreement to Terms

These Terms constitute a legally binding agreement between you and Believe PR. By using the App, you represent that:

• You are at least 13 years of age (or the minimum age required in your jurisdiction)
• You have the legal capacity to enter into these Terms
• You will use the App in compliance with all applicable laws and regulations

1.2 Additional Terms

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

2. App Description

2.1 Purpose

Devotion is an AI-powered daily devotional app designed for Christians. It provides a personalized spiritual experience by generating daily devotional content that includes scripture, reflections, prayers, affirmations, and action steps.

2.2 Features

• Daily Devotional Generation: One AI-generated devotional per day, personalized to your mood and chosen category
• Personalization: Optional mood text entry and category selection (Gratitude, Peace, Hope, Strength, Healing, Joy, Forgiveness, Purpose, Patience, Guidance)
• Devotional History: Browse and re-read all your past devotionals
• Bookmarks: Save your favorite devotionals for quick access
• Daily Reminders: Customizable push notifications for your devotional practice
• Light & Dark Mode: Full theme support for comfortable reading

2.3 Availability

• Platforms: iOS and Android
• Internet Required: Active internet connection is required to generate new devotionals
• Offline Access: Previously generated devotionals are available offline

3. License to Use

3.1 Grant of License

Subject to your compliance with these Terms, Believe PR grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on your personal mobile device for personal, non-commercial use.

3.2 License Restrictions

You may NOT:

• Copy, modify, or distribute the App or any part of it
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, lend, sell, or sublicense the App
• Remove or alter any proprietary notices or labels
• Use the App to develop competing products
• Use automated scripts or bots to interact with the App

3.3 Ownership

The App, including all intellectual property rights, remains the sole property of Believe PR. This license does not give you any ownership interest in the App.

4. User Obligations

4.1 Responsible Use

You agree to use the App responsibly and in accordance with its intended purpose as a personal devotional tool. Specifically:

• Use the App for personal spiritual enrichment only
• Do not rely on AI-generated content as a substitute for pastoral guidance, professional counseling, or medical advice
• Maintain the security of your device to protect your devotional data

4.2 Data Responsibility

Since all devotional data is stored locally on your device:

• You are responsible for backing up your device
• Deleting the app permanently removes all your devotional data
• We cannot recover deleted data under any circumstances

5. AI-Generated Content Disclaimer

5.1 Nature of AI Content

• AI-generated devotionals are not reviewed, approved, or endorsed by any church, denomination, pastor, or religious authority
• Content may occasionally contain inaccuracies in biblical references, historical facts, or theological interpretations
• AI-generated content should be considered a supplement to, not a replacement for, personal Bible study and community worship

5.2 No Professional Advice

Content generated by Devotion does NOT constitute:

• Professional pastoral or spiritual counseling
• Mental health advice or therapy
• Medical, legal, or financial guidance
• Official doctrine or theological instruction

5.3 User Responsibility

You are solely responsible for:

• Evaluating the accuracy and applicability of generated content
• Cross-referencing scripture citations with an authoritative Bible translation — AI may occasionally paraphrase, misattribute, or conflate verses
• Seeking qualified pastoral or professional guidance for serious spiritual, emotional, or life concerns
• Any actions taken based on AI-generated content

6. Subscriptions & Purchases

6.1 Subscription Options

Devotion offers premium subscription tiers with enhanced features:

• Monthly Subscription: Auto-renewing monthly billing cycle
• Annual Subscription: Auto-renewing annual billing cycle

6.2 Payment & Billing

• All payments are processed through the Apple App Store or Google Play Store
• Subscription management is powered by RevenueCat
• Prices are displayed in your local currency at checkout
• Payment is charged to your App Store or Play Store account at confirmation of purchase

6.3 Auto-Renewal

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• Renewal price is the same as the original subscription price unless otherwise notified

6.4 Cancellation

• You can cancel your subscription at any time through your App Store or Play Store settings
• Cancellation takes effect at the end of the current billing period
• You will retain access to premium features until the end of your paid period
• Canceling does not entitle you to a refund for the current billing period

6.5 Refunds

Refund requests must be directed to the platform where the purchase was made:

• Apple: reportaproblem.apple.com
• Google: Google Play refund page

Refund eligibility is determined by Apple's and Google's respective refund policies.

6.6 Price Changes

We reserve the right to modify subscription pricing. Any price change will:

• Be communicated in advance through the App Store or Play Store
• Not affect your current billing period
• Require your consent before the new price takes effect (per platform requirements)

7. Intellectual Property

7.1 App Content

All content within the App, including but not limited to:

• App design, UI elements, and visual assets
• Brand name, logos, and trademarks
• Source code and software
• Prompt templates and AI generation systems

are the exclusive property of Believe PR or its licensors and are protected by applicable intellectual property laws.

7.2 AI-Generated Content

• AI-generated devotional content is created for your personal, non-commercial use
• You may share devotional content with others for personal and non-commercial purposes
• Mass reproduction, redistribution for profit, or use in competing applications is prohibited

7.3 Scripture

Bible verses and scriptural references included in devotionals are from publicly available translations. Specific translation copyrights belong to their respective rights holders.

8. Prohibited Uses

You agree NOT to use the App to:

• Violate any applicable laws or regulations
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Systematically extract or scrape content
• Use the App for any commercial purpose without authorization
• Manipulate or abuse the AI content generation system
• Attempt to generate harmful, hateful, or inappropriate content through the AI system
• Misrepresent AI-generated content as professional pastoral, medical, or psychological advice

9. Termination

9.1 Termination by You

You may stop using the App at any time by:

• Deleting the App from your device
• Canceling any active subscription

9.2 Termination by Us

We may block your access to AI features or discontinue your use of the App if:

• You violate these Terms
• You engage in prohibited uses
• Required by law or legal process
• We discontinue the App

9.3 Effect of Termination

Upon termination:

• Your license to use the App is immediately revoked
• All local data will remain on your device until you delete the App
• Any active subscription will continue until the end of the paid period (you must cancel separately)
• Sections on disclaimers, liability, indemnification, and governing law survive termination

10. Disclaimers

10.1 "As Is" Provision

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of AI-generated content
• Uninterrupted or error-free operation

10.2 No Spiritual or Religious Endorsement

Devotion is an independent app and is NOT:

• Affiliated with, endorsed by, or representative of any church, denomination, or religious organization
• A substitute for community worship, pastoral guidance, or formal religious education
• Guaranteed to be theologically accurate or comprehensive

10.3 AI Limitations

Artificial intelligence has inherent limitations. AI-generated content may:

• Contain errors in scripture citations or historical facts
• Produce inconsistent theological interpretations
• Not reflect the specific doctrinal positions of your faith community
• Be unavailable during service outages

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• Believe PR shall NOT be liable for any indirect, incidental, special, consequential, or punitive damages
• This includes, but is not limited to: loss of data, spiritual distress, emotional harm, or any damages arising from reliance on AI-generated content
• Our total liability shall not exceed the greater of (a) the amount you paid for the App in the twelve (12) months preceding the claim, or (b) fifty US dollars ($50.00)
• Some jurisdictions do not allow certain liability exclusions; in such cases, liability is limited to the maximum extent permitted by law

12. Indemnification

You agree to indemnify, defend, and hold harmless Believe PR, its owner Armando Jimenez, and any affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any applicable law or the rights of a third party
• Any actions taken based on AI-generated content

13. Governing Law

13.1 Applicable Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Puerto Rico, without regard to its conflict-of-law provisions.

13.2 Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

1. Good Faith Negotiation: We encourage you to contact us first to resolve any concerns informally
2. Mediation: If negotiation fails, disputes may be submitted to mediation
3. Small Claims: Either party may bring an individual action in small claims court in Puerto Rico if the claim qualifies
4. Jurisdiction: Any legal proceedings shall be brought in the courts of Puerto Rico

13.3 Miscellaneous

• Entire Agreement: These Terms, along with the Privacy Policy, constitute the entire agreement between you and Believe PR
• Severability: If any provision of these Terms is found invalid, the remaining provisions continue in full force
• Waiver: Failure to enforce any provision does not constitute a waiver of that provision
• Assignment: You may not assign your rights under these Terms; we may assign ours at any time

14. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

• The "Last Updated" date at the top of this page will be revised
• Significant changes will be communicated through the App or via the applicable app store
• For material changes, we will display a prominent in-app notice and, where required by applicable law, request your renewed consent

We encourage you to review these Terms periodically. If you disagree with any changes, your sole remedy is to stop using the App and cancel any active subscription.

Governing Language

These Terms & Conditions are provided in English and Spanish. In the event of any conflict or inconsistency between the English and Spanish versions, the English version shall prevail.
