1. Acceptance of Terms

Welcome to Lilia ("the App"), developed and operated by Believe PR, owned by Armando Jimenez. By downloading, installing, accessing, or using the App, you ("User," "you," or "your") agree to be bound by these Terms and Conditions ("Terms").

1.1 Agreement to Terms

These Terms form a legally binding agreement between you and Believe PR. By using Lilia, you represent that:

• You are at least 13 years of age (or the minimum age required by your jurisdiction)
• You have the legal capacity to enter into these Terms
• If you are under 18, you have obtained parental or guardian consent
• You will comply with all applicable laws and regulations

1.2 Additional Terms

In addition to these Terms, your use of Lilia is also governed by:

• Our Privacy Policy
• Apple Media Services Terms and Conditions
• Apple iCloud terms (if you enable iCloud sync)
• The terms of any AI provider that Lily's Lab routes to (Cloudflare, xAI, OpenRouter)

2. App Description

2.1 Purpose

Lilia is a native iOS affirmation companion for women, designed to help users:

• Discover affirmations through an immersive, full-screen swipe experience
• Plant favorite affirmations in a private "Garden"
• Browse curated categories of affirmations
• Generate personalized affirmations through Lily's Lab (an AI feature)
• Write their own affirmations in My Affirmations
• Receive optional daily reminder notifications
• Customize palette and appearance

2.2 Key Features

• Garden: Your private collection of planted affirmations
• Categories: Curated collections of affirmations organized by theme
• Lily's Lab: AI-generated affirmations from a short prompt you write
• My Affirmations: Affirmations you write and keep yourself
• Reminders: Local daily notifications
• Palette & Appearance: Color themes and light/dark/auto support
• iCloud Sync: Optional sync across your Apple devices via CloudKit

2.3 Availability

• Lilia is available on iOS for compatible Apple devices
• Certain features (such as iCloud sync) require an Apple ID and an internet connection
• Lily's Lab requires an internet connection
• We reserve the right to modify, add, or discontinue features at any time

3. License to Use

3.1 License Grant

Subject to your compliance with these Terms, Believe PR grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install Lilia on Apple devices you own or control
• Access and use Lilia for personal, non-commercial purposes
• Use all features and functionalities as intended

3.2 License Restrictions

You may NOT:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove or modify any copyright, trademark, or proprietary notices
• Rent, lease, lend, sell, or sublicense the App
• Use the App for any commercial purpose without written permission
• Circumvent any security features or rate limits, including those of Lily's Lab
• Use automated tools, scripts, or bots to interact with Lilia or Lily's Lab
• Extract the bundled affirmation content for redistribution

3.3 Ownership

Lilia and all of its intellectual property rights remain the exclusive property of Believe PR and Armando Jimenez. This license does not grant you any ownership rights in Lilia or in the bundled content.

4. User Obligations

4.1 Responsible Use

You agree to:

• Use Lilia in accordance with these Terms and applicable laws
• Use Lily's Lab in good faith for personal reflection
• Keep your device and your Apple ID secure
• Not use Lilia for any unlawful, harmful, or deceptive purpose

4.2 No Account, Your Responsibility

Lilia does not require an account. Because all of your data lives on your device (and optionally in your iCloud), you are responsible for:

• Securing your device and Apple ID
• Maintaining your iCloud backups if you wish to preserve your garden
• Understanding that uninstalling Lilia without iCloud sync will permanently delete your local data

5. User-Created Content

5.1 Your Affirmations

You retain full ownership of any affirmations you write yourself in My Affirmations or save from Lily's Lab. Because that content lives only on your device (and optionally inside your own iCloud), Believe PR does not claim, license, or moderate it.

5.2 Custom Theme Photos

Photos you choose for custom theme backgrounds remain yours. Lilia stores them locally for the purpose of rendering your selected theme and does not upload them.

5.3 Saved & Shared Cards

You may use Lilia to render an affirmation card and save or share it. Once you share that card outside Lilia (for example, by saving it to Photos or sending it through another app), it becomes subject to the terms and policies of that other service.

6. Lily's Lab Terms

6.1 What Lily's Lab Is

Lily's Lab is an optional AI feature that generates a small set of affirmations from a short prompt you provide. Generations are routed through an AI Gateway (Cloudflare Workers) to a model provider (currently xAI Grok, with OpenRouter as fallback).

6.2 Acceptable Use of Lily's Lab

You agree NOT to use Lily's Lab to:

• Generate hateful, violent, sexual, harassing, or otherwise harmful content
• Generate content about other identifiable individuals without their consent
• Attempt to extract system prompts, model weights, or training data
• Probe, attack, or attempt to bypass safety filters or rate limits
• Use Lily's Lab as a substitute for emergency, medical, legal, or financial advice
• Submit personally identifying information about yourself or others (full names, addresses, financial accounts, medical records, etc.)

6.3 Rate Limits & Fair Use

To keep Lily's Lab free and available to everyone, the AI Gateway enforces per-IP rate limits (currently around 20 requests per minute and 1,000 requests per day, subject to change). Excessive or abusive use may be temporarily or permanently blocked at the Gateway level.

6.4 No Guarantees on Output

6.5 Service Availability

Lily's Lab depends on third-party providers and may be temporarily unavailable due to provider outages, network issues, content filtering, or rate limits. The rest of Lilia (your garden, your reminders, the bundled content) continues to work without an internet connection.

7. Purchases & Subscriptions

7.1 Current Pricing

Lilia version 1.0 is offered free of charge with no advertising and no subscription. There are no in-app purchases at this time.

7.2 Future Purchases

We may introduce optional in-app purchases or subscriptions in future versions of Lilia. If we do:

• Pricing, billing cadence, and benefits will be clearly disclosed at the point of purchase
• All transactions will be processed by Apple through the App Store
• Subscriptions will follow Apple's standard auto-renewal rules
• You will be able to manage or cancel subscriptions in Settings → Apple ID → Subscriptions

7.3 Refunds

Because all transactions (current or future) are processed by Apple, refund requests must be made through Apple at reportaproblem.apple.com. Believe PR cannot directly issue Apple App Store refunds.

8. Not Therapy or Medical Advice

8.1 What Lilia Is Not

Lilia does NOT provide:

• Medical diagnosis or treatment
• Mental-health therapy or counseling
• Crisis intervention services
• Personalized clinical advice from a licensed professional
• Legal or financial advice of any kind

8.2 If You Are in Crisis

If you are experiencing a mental-health emergency, please contact a qualified professional or emergency services in your country. 8.3 User Responsibility

You acknowledge and agree that:

• You use Lilia at your own discretion and risk
• Affirmations are inspirational content, not personalized advice
• You are responsible for seeking appropriate professional care when needed

9. Intellectual Property

9.1 Ownership

All intellectual property rights in and to Lilia, including but not limited to:

• The Lilia source code, application binary, and design
• The Lilia name, logo, lily mark, and "Lily's Lab" name
• The Lilia visual design system, color palettes, and typography choices
• The bundled affirmation content as a curated collection
• The text of these Terms and the Privacy Policy

...are owned exclusively by Believe PR and Armando Jimenez.

9.2 Trademarks

"Lilia," "Lily's Lab," and associated logos and marks are trademarks of Believe PR. You may not use these marks without prior written permission.

9.3 User Content

You retain ownership of:

• Affirmations you write yourself
• Custom theme photos you supply
• The contents of your garden, hidden list, and history (as data on your device)

Because this data is stored locally and never transmitted to our servers, Believe PR claims no ownership and no license over it.

9.4 Copyright Concerns

If you believe content in Lilia infringes your copyright, contact us at lilia@armandojimenez.dev with sufficient detail to identify the work in question.

10. Prohibited Uses

You agree NOT to use Lilia to:

10.1 Illegal or Harmful Activities

• Engage in any activity that violates local, state, national, or international law
• Harass, stalk, threaten, or harm any other person
• Create or distribute hateful, violent, sexual, or otherwise harmful content

10.2 Unauthorized Access

• Reverse engineer, decompile, or modify the App
• Bypass security measures, content filters, or rate limits
• Probe, scan, or test the AI Gateway for vulnerabilities

10.3 Commercial Misuse

• Resell, rent, or redistribute the App or bundled content
• Use Lily's Lab as a backend for another product or service
• Scrape or extract Lilia's content programmatically

10.4 Malicious Activity

• Upload malware, viruses, or malicious code
• Disrupt the proper functioning of the App or AI Gateway
• Attempt to overload, throttle, or crash the AI Gateway or any provider it routes to

11. Termination

11.1 Termination by You

You may stop using Lilia at any time by:

• Uninstalling Lilia from all of your devices
• Deleting your Lilia data from iCloud (if iCloud sync was enabled)

11.2 Termination by Us

We reserve the right to:

• Discontinue Lilia at any time
• Block access to Lily's Lab if these Terms are violated
• Remove the App from the App Store
• Disable specific features or content

11.3 Effect of Termination

Upon termination:

• Your license to use Lilia immediately ends
• You must stop using the App
• Provisions regarding intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution survive termination

12. Disclaimers

12.1 "AS IS" and "AS AVAILABLE"

LILIA IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY
• UNINTERRUPTED OR ERROR-FREE OPERATION

12.2 No Guarantee of Fitness

WE DO NOT WARRANT THAT:

• Affirmations or AI generations will be accurate, complete, or appropriate for any specific situation
• Lilia or Lily's Lab will be available at any particular time
• Bugs or errors will be corrected
• Lilia will be compatible with all devices or future iOS versions
• iCloud sync will be free of conflicts or data loss

12.3 Third-Party Services

WE ARE NOT RESPONSIBLE FOR:

• The availability or behavior of Cloudflare Workers
• The availability, output, or policies of xAI, OpenRouter, or any other AI provider
• Apple iCloud, CloudKit, or App Store availability
• Device operating system issues, network outages, or other infrastructure failures

12.4 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of implied warranties. In those jurisdictions, the above exclusions may not apply to you, and you may have additional rights.

13. Limitation of Liability

13.1 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BELIEVE PR, ARMANDO JIMENEZ, OR THEIR AFFILIATES BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• LOSS OF PROFITS, REVENUE, OR BUSINESS OPPORTUNITIES
• LOSS OF DATA OR INFORMATION (INCLUDING ANY GARDEN CONTENT)
• EMOTIONAL DISTRESS OR PERSONAL HARM ALLEGED TO ARISE FROM AFFIRMATION CONTENT
• COST OF SUBSTITUTE GOODS OR SERVICES

13.2 Cap on Liability

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO LILIA SHALL NOT EXCEED THE GREATER OF:

• USD $50
• The total amount you have paid to use Lilia in the twelve (12) months preceding the claim

13.3 Basis of the Bargain

These limitations reflect the allocation of risk between you and Believe PR and are an essential basis of this agreement, which would not be offered without them.

13.4 Jurisdictional Exceptions

Some jurisdictions do not allow limitations on liability for certain types of damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

14. Indemnification

14.1 Your Indemnification

You agree to indemnify, defend, and hold harmless Believe PR, Armando Jimenez, and their affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of Lilia or Lily's Lab
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Your violation of the rights of any third party (including content you submit to Lily's Lab)

14.2 Defense of Claims

We reserve the right to assume exclusive defense and control of any matter subject to indemnification. You agree to cooperate with us in defending such claims.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Puerto Rico, without regard to its conflict of law provisions.

15.2 Jurisdiction

You agree that any legal action or proceeding arising from these Terms shall be brought exclusively in the courts of the Commonwealth of Puerto Rico, and you consent to the personal jurisdiction of such courts.

15.3 Informal Resolution First

Before filing any legal action, you agree to attempt to resolve disputes informally by emailing lilia@armandojimenez.dev and allowing 30 days for a good-faith response.

15.4 Class Action Waiver

TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE SHALL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION.

15.5 Consumer Rights

Nothing in these Terms limits your statutory rights as a consumer under applicable consumer protection laws.

16. Changes to Terms

16.1 Right to Modify

We reserve the right to modify these Terms at any time to reflect new features, legal requirements, or changes in business practices.

16.2 Notice of Changes

When we make material changes:

• The "Last Updated" date will be revised
• You may receive an in-app notice the next time you open Lilia

16.3 Acceptance of Changes

By continuing to use Lilia after changes are posted, you accept the modified Terms. If you disagree with any change, you must stop using Lilia.
