1. Acceptance of Terms

Welcome to Refract ("the App"), developed and operated by Believe PR, owned by Armando Jimenez. By downloading, installing, accessing, or using the App, you ("User," "you," or "your") agree to be bound by these Terms and Conditions ("Terms").

1.1 Agreement to Terms

These Terms form a legally binding agreement between you and Believe PR. By using Refract, you represent that:

• You are at least 13 years of age (or the minimum age required by your jurisdiction)
• You have the legal capacity to enter into these Terms
• If you are under 18, you have obtained parental or guardian consent
• You will comply with all applicable laws and regulations

1.2 Additional Terms

In addition to these Terms, your use of Refract is also governed by:

• Our Privacy Policy
• The App Store or Google Play terms for your platform
• The terms of the AI provider that your request is routed to

2. App Description

2.1 Purpose

Refract is a cross-platform (iOS and Android) reflective companion that lets you:

• Bring a mood, a topic, or a few words, and receive a message composed in real time
• Choose one of six wavelengths (registers of care, such as an affirmation, a spark of courage, a practical tip, or a gentle reminder), or let the prism choose for you
• Keep the messages that land, in your own private, on-device collection
• Write your own line, optionally polished by the App's AI feature
• Write letters to your future self and seal them for a chosen delivery date
• Share a beautifully rendered card, and optionally save it to your device
• Receive an optional gentle daily reminder, and add a home-screen widget

2.2 Key Features

• Refract: A request, a chosen wavelength, and a message composed in real time
• Keep: Your private, on-device collection of messages you saved
• Future Self: Letters you write now and seal for later delivery
• Create your own: Write your own line, with optional AI polish
• Share: An optional, beautifully rendered card you can share or save from your device
• Daily Reminder & Widget: A gentle local reminder and today's light on your home screen
• Appearance: Morning Light and Quiet Evening themes, both languages (English and Spanish)

2.3 Availability

• Refract is available on iOS and Android
• Composing a new message requires an internet connection. Your collection, your Future Self letters, "Create your own," the daily reminder, the widget, and backup continue to work offline
• We reserve the right to modify, add, or discontinue features at any time

3. License to Use

3.1 License Grant

Subject to your compliance with these Terms, Believe PR grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install Refract on devices you own or control
• Access and use Refract for personal, non-commercial purposes
• Use all features and functionalities as intended

3.2 License Restrictions

You may NOT:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove or modify any copyright, trademark, or proprietary notices
• Rent, lease, lend, sell, or sublicense the App
• Use the App for any commercial purpose without written permission
• Circumvent any security features or rate limits, including those of the AI Gateway
• Use automated tools, scripts, or bots to interact with Refract or its Gateway

3.3 Ownership

Refract and all of its intellectual property rights remain the exclusive property of Believe PR and Armando Jimenez. This license does not grant you any ownership rights in the App.

4. User Obligations

4.1 Responsible Use

You agree to:

• Use Refract in accordance with these Terms and applicable laws
• Make requests in good faith, for personal reflection
• Keep your device secure
• Not use Refract for any unlawful, harmful, or deceptive purpose

4.2 No Account, Your Responsibility

Refract does not require an account. Because all of your data lives on your device, you are responsible for:

• Securing your device
• Understanding that uninstalling Refract will permanently delete your local collection and letters, as there is no cloud backup (the App offers a free manual export so you can keep your own copy)

5. Your Messages & Letters

5.1 Your Content

You retain full ownership of the requests and lines you write and the messages you keep in your collection. Because that content lives only on your device, Believe PR does not claim, license, or moderate it, and we never receive a copy of your collection or your Future Self letters.

5.2 Shared Cards

You may use Refract to render a card from a message and share it. Once you share that card outside the App (for example, by sending it through another app or saving it to your gallery), it becomes subject to the terms and policies of that other service.

6. The AI Feature

6.1 What It Is

Messages in Refract are composed by a large language model. Your request is routed through an AI Gateway (Cloudflare Workers) to a third-party model provider (currently the Qwen family of models, configured server-side).

6.2 Acceptable Use

You agree NOT to use the App to:

• Generate hateful, violent, sexual, harassing, or otherwise harmful content
• Generate content about other identifiable individuals without their consent
• Attempt to extract system prompts, model weights, or training data
• Probe, attack, or attempt to bypass safety filters or rate limits
• Use messages as a substitute for emergency, medical, legal, or financial advice
• Submit personally identifying information about yourself or others (full names, addresses, account numbers, government IDs, or medical records)

6.3 Rate Limits & Fair Use

To keep the App available to everyone, the AI Gateway enforces per-device and per-IP rate limits (subject to change). The free tier also limits how many new messages you can compose each day; this is separate from the Gateway's anti-abuse limits. Excessive or abusive use may be temporarily or permanently blocked at the Gateway level.

6.4 No Guarantees on Output

6.5 Service Availability

Composing a message depends on third-party providers and may be temporarily unavailable due to provider outages, network issues, content filtering, or rate limits. The rest of Refract (your collection, your Future Self letters, your daily reminder, your widget, and backup) continues to work without an internet connection.

7. Subscriptions & Auto-Renewal

7.1 Free Tier & Refract Premium

Refract is free to use, with a generous free tier. Free dark mode and the free manual backup are never gated.

Refract Premium is an optional auto-renewing subscription that unlocks:

• Unlimited refractions
• An unlimited collection
• A longer Future Self delivery horizon
• Wallpaper exports and other premium touches

7.2 Pricing & Billing

• Pricing, billing cadence, trial length, and benefits are clearly disclosed inside the App at the point of purchase, in your local currency where the store supports it. Prices and any trial length may change over time; the price shown in the App and at checkout always governs
• All charges are made by the Apple App Store or Google Play to your store account. Believe PR never sees or stores your card or payment details
• Subscriptions auto-renew at the end of each period unless you cancel at least 24 hours before the renewal date
• A free-trial period, where offered, converts to a paid subscription at the end of the trial unless canceled before that time
• We use RevenueCat to verify your subscription status; payment is always handled by the store, not by RevenueCat or Believe PR

7.3 Managing Your Subscription

You can manage, change, or cancel your Refract Premium subscription at any time in your device's store settings — on iOS in Settings → Apple ID → Subscriptions, and on Android in Google Play → Payments & subscriptions → Subscriptions. The App links you there. Canceling stops the next renewal but leaves your access active for the remainder of the paid period.

7.4 Refunds

Because all transactions are processed by the store, refund requests must be made through the store: Apple at reportaproblem.apple.com, or Google Play through its purchase history. Believe PR cannot directly issue App Store or Google Play refunds.

7.5 Price Changes

We may change subscription prices over time. The store will notify existing subscribers of any material price increase and request consent as required by the App Store or Google Play rules of your region.

8. Not Fortune-Telling or Professional Advice

8.1 What Refract Is Not

Refract does NOT provide:

• Predictions of the future or fortune-telling
• Medical diagnosis or treatment
• Mental-health therapy, counseling, or crisis intervention
• Personalized financial, investment, tax, or legal advice
• Guarantees of any specific outcome in your life

8.2 Messages Are Reflection, Not Prediction

The messages in Refract are creative reflections meant to encourage and to offer a moment of perspective. They are not predictions, forecasts, or commitments, by you, by us, or by any third party. Outcomes in your life depend on factors entirely outside the App.

8.3 If You Are in Crisis

If you are experiencing a mental-health emergency or are in crisis, please reach out to a trained human right away. Visit findahelpline.com to find a free, confidential helpline in your country, or contact your local emergency services.

8.4 User Responsibility

You acknowledge and agree that:

• You use Refract at your own discretion and risk
• Messages are inspirational and creative content, not personalized advice
• You are responsible for your own decisions, and for seeking appropriate professional care when needed

9. Intellectual Property

9.1 Ownership

All intellectual property rights in and to Refract, including but not limited to:

• The Refract source code, application binary, and design
• The Refract name, wordmark, prism mark, and the six-wavelength visual system
• The color palettes, typography choices, and the prism rendering engine
• The text of these Terms and the Privacy Policy

...are owned exclusively by Believe PR and Armando Jimenez.

9.2 Trademarks

"Refract" and associated logos and marks are trademarks of Believe PR. You may not use these marks without prior written permission.

9.3 Your Content

You retain ownership of the lines you write and the messages you keep. Because this data is stored locally and never transmitted to our servers, Believe PR claims no ownership and no license over it.

9.4 Copyright Concerns

If you believe content in Refract infringes your copyright, contact us at refract@armandojimenez.dev with sufficient detail to identify the work in question.

10. Prohibited Uses

You agree NOT to use Refract to:

10.1 Illegal or Harmful Activities

• Engage in any activity that violates local, state, national, or international law
• Harass, stalk, threaten, or harm any other person
• Create or distribute hateful, violent, sexual, or otherwise harmful content

10.2 Unauthorized Access

• Reverse engineer, decompile, or modify the App
• Bypass security measures, content filters, or rate limits
• Probe, scan, or test the AI Gateway for vulnerabilities

10.3 Commercial Misuse

• Resell, rent, or redistribute the App
• Use the AI Gateway as a backend for another product or service
• Scrape or extract the App's content programmatically

10.4 Malicious Activity

• Upload malware, viruses, or malicious code
• Disrupt the proper functioning of the App or AI Gateway
• Attempt to overload, throttle, or crash the AI Gateway or any provider it routes to

11. Termination

11.1 Termination by You

You may stop using Refract at any time by uninstalling it from all of your devices. This permanently removes your local data. Uninstalling the App does not by itself cancel a subscription — cancel that in your store settings (section 7.3).

11.2 Termination by Us

We reserve the right to:

• Discontinue Refract at any time
• Block access to the AI Gateway if these Terms are violated
• Remove the App from the App Store or Google Play
• Disable specific features or content

11.3 Effect of Termination

• Your license to use Refract immediately ends
• You must stop using the App
• Provisions regarding intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution survive termination

12. Disclaimers

12.1 "AS IS" and "AS AVAILABLE"

REFRACT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY
• UNINTERRUPTED OR ERROR-FREE OPERATION

12.2 No Guarantee of Outcome

WE DO NOT WARRANT THAT:

• Messages or AI generations will be accurate, complete, or appropriate for any specific situation
• Use of Refract will lead to any specific personal, emotional, or material outcome
• The App or its AI feature will be available at any particular time
• Bugs or errors will be corrected
• Refract will be compatible with all devices or future operating-system versions

12.3 Third-Party Services

WE ARE NOT RESPONSIBLE FOR:

• The availability or behavior of Cloudflare Workers
• The availability, output, or policies of the AI model provider
• The availability or behavior of RevenueCat, the Apple App Store, or Google Play
• Device operating-system issues, network outages, or other infrastructure failures

12.4 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of implied warranties. In those jurisdictions, the above exclusions may not apply to you, and you may have additional rights.

13. Limitation of Liability

13.1 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BELIEVE PR, ARMANDO JIMENEZ, OR THEIR AFFILIATES BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• LOSS OF PROFITS, REVENUE, OR BUSINESS OPPORTUNITIES
• LOSS OF DATA OR INFORMATION (INCLUDING ANY COLLECTION OR LETTER CONTENT)
• DECISIONS INFLUENCED IN ANY WAY BY MESSAGE CONTENT
• EMOTIONAL DISTRESS OR PERSONAL HARM ALLEGED TO ARISE FROM APP CONTENT
• COST OF SUBSTITUTE GOODS OR SERVICES

13.2 Cap on Liability

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO REFRACT SHALL NOT EXCEED THE GREATER OF:

• USD $50
• The total amount you have paid to use Refract in the twelve (12) months preceding the claim

13.3 Basis of the Bargain

These limitations reflect the allocation of risk between you and Believe PR and are an essential basis of this agreement, which would not be offered without them.

13.4 Jurisdictional Exceptions

Some jurisdictions do not allow limitations on liability for certain types of damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

14. Indemnification

14.1 Your Indemnification

You agree to indemnify, defend, and hold harmless Believe PR, Armando Jimenez, and their affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of Refract or its AI feature
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Your violation of the rights of any third party (including content you submit)

14.2 Defense of Claims

We reserve the right to assume exclusive defense and control of any matter subject to indemnification. You agree to cooperate with us in defending such claims.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Puerto Rico, without regard to its conflict of law provisions.

15.2 Jurisdiction

You agree that any legal action or proceeding arising from these Terms shall be brought exclusively in the courts of the Commonwealth of Puerto Rico, and you consent to the personal jurisdiction of such courts.

15.3 Informal Resolution First

Before filing any legal action, you agree to attempt to resolve disputes informally by emailing refract@armandojimenez.dev and allowing 30 days for a good-faith response.

15.4 Class Action Waiver

TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE SHALL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION.

15.5 Consumer Rights

Nothing in these Terms limits your statutory rights as a consumer under applicable consumer-protection laws.

16. Changes to Terms

16.1 Right to Modify

We reserve the right to modify these Terms at any time to reflect new features, legal requirements, or changes in business practices.

16.2 Notice of Changes

When we make material changes:

• The "Last Updated" date will be revised
• You may receive an in-app notice the next time you open Refract

16.3 Acceptance of Changes

By continuing to use Refract after changes are posted, you accept the modified Terms. If you disagree with any change, you must stop using the App.
