1. Acceptance of Terms

Welcome to Wealthy ("the App"), developed and operated by Believe PR, owned by Armando Jimenez. By downloading, installing, accessing, or using the App, you ("User," "you," or "your") agree to be bound by these Terms and Conditions ("Terms").

1.1 Agreement to Terms

These Terms form a legally binding agreement between you and Believe PR. By using Wealthy, you represent that:

• You are at least 13 years of age (or the minimum age required by your jurisdiction)
• You have the legal capacity to enter into these Terms
• If you are under 18, you have obtained parental or guardian consent
• You will comply with all applicable laws and regulations

1.2 Additional Terms

In addition to these Terms, your use of Wealthy is also governed by:

• Our Privacy Policy
• Apple Media Services Terms and Conditions
• Apple iCloud terms (if you enable iCloud sync)
• RevenueCat's terms (subscription management layer)
• The terms of any AI provider that Mint routes to (Cloudflare, xAI, OpenRouter)

2. App Description

2.1 Purpose

Wealthy is a native iOS affirmation companion focused on wealth, abundance, and money mindset, designed to help users:

• Discover affirmations through an immersive, full-screen swipe experience
• Save favorite affirmations to a private "Vault"
• Browse curated categories of money, abundance, and wealth-identity affirmations
• Generate personalized affirmations through Mint (an AI feature)
• Write their own affirmations in My Favorites
• Receive optional daily reminder notifications
• Customize palette and appearance

2.2 Key Features

• Vault: Your private collection of saved affirmations
• Categories: Curated collections of affirmations organized by theme (Daily Wealth, Abundance, Wealth Identity, Manifesting, Money Confidence, Earning Power, and more)
• Mint: AI-generated affirmations from a short prompt you write
• My Favorites: Affirmations you write or favorite for yourself
• Reminders: Local daily notifications
• Palette & Appearance: Color themes and light/dark/auto support
• Widget: Daily Wealth card surfaced on your Home Screen
• iCloud Sync: Optional sync across your Apple devices via CloudKit
• Wealthy Vault (paid tier): Optional subscription that unlocks the full library and additional Mint capacity

2.3 Availability

• Wealthy is available on iOS for compatible Apple devices
• Certain features (such as iCloud sync, Mint, and Wealthy Vault) require an Apple ID and an internet connection
• We reserve the right to modify, add, or discontinue features at any time

3. License to Use

3.1 License Grant

Subject to your compliance with these Terms, Believe PR grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install Wealthy on Apple devices you own or control
• Access and use Wealthy for personal, non-commercial purposes
• Use all features and functionalities as intended, including any Wealthy Vault features you have an active subscription to

3.2 License Restrictions

You may NOT:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove or modify any copyright, trademark, or proprietary notices
• Rent, lease, lend, sell, or sublicense the App
• Use the App for any commercial purpose without written permission
• Circumvent any security features, rate limits, or entitlement checks, including those of Mint and Wealthy Vault
• Use automated tools, scripts, or bots to interact with Wealthy or Mint
• Extract the bundled affirmation content for redistribution

3.3 Ownership

Wealthy and all of its intellectual property rights remain the exclusive property of Believe PR and Armando Jimenez. This license does not grant you any ownership rights in Wealthy or in the bundled content.

4. User Obligations

4.1 Responsible Use

You agree to:

• Use Wealthy in accordance with these Terms and applicable laws
• Use Mint in good faith for personal reflection on your relationship with money
• Keep your device and your Apple ID secure
• Not use Wealthy for any unlawful, harmful, or deceptive purpose

4.2 No Account, Your Responsibility

Wealthy does not require an account. Because all of your data lives on your device (and optionally in your iCloud), you are responsible for:

• Securing your device and Apple ID
• Maintaining your iCloud backups if you wish to preserve your Vault
• Understanding that uninstalling Wealthy without iCloud sync will permanently delete your local data

5. User-Created Content

5.1 Your Affirmations

You retain full ownership of any affirmations you write yourself in My Favorites or save from Mint. Because that content lives only on your device (and optionally inside your own iCloud), Believe PR does not claim, license, or moderate it.

5.2 Custom Theme Photos

Photos you choose for custom theme backgrounds remain yours. Wealthy stores them locally for the purpose of rendering your selected theme and does not upload them.

5.3 Saved & Shared Cards

You may use Wealthy to render an affirmation card and save or share it. Once you share that card outside Wealthy (for example, by saving it to Photos or sending it through another app), it becomes subject to the terms and policies of that other service.

6. Mint Terms

6.1 What Mint Is

Mint is an optional AI feature that generates a small set of affirmations from a short prompt you provide. Generations are routed through an AI Gateway (Cloudflare Workers) to a model provider (currently xAI Grok, with OpenRouter as fallback).

6.2 Acceptable Use of Mint

You agree NOT to use Mint to:

• Generate hateful, violent, sexual, harassing, or otherwise harmful content
• Generate content about other identifiable individuals without their consent
• Attempt to extract system prompts, model weights, or training data
• Probe, attack, or attempt to bypass safety filters or rate limits
• Use Mint as a substitute for emergency, medical, legal, tax, or financial advice
• Generate get-rich-quick schemes, fraudulent investment advice, or content that pressures another person into a financial decision
• Submit personally identifying information about yourself or others (full names, addresses, real bank or brokerage account numbers, credit-card numbers, medical records, etc.)

6.3 Rate Limits & Fair Use

To keep Mint available to everyone, the AI Gateway enforces per-IP rate limits (currently around 20 requests per minute and 1,000 requests per day, subject to change). Wealthy Vault subscribers may receive higher daily limits. Excessive or abusive use may be temporarily or permanently blocked at the Gateway level.

6.4 No Guarantees on Output

6.5 Service Availability

Mint depends on third-party providers and may be temporarily unavailable due to provider outages, network issues, content filtering, or rate limits. The rest of Wealthy (your Vault, your reminders, the bundled content, your widget) continues to work without an internet connection.

7. Wealthy Vault & Purchases

7.1 Free Tier

Wealthy is free to download and use. The free tier includes a generous selection of affirmations, the Daily Wealth card, basic reminders, the widget, and limited Mint generations.

7.2 Wealthy Vault Subscription

Wealthy Vault is an optional auto-renewing subscription that unlocks:

• The full curated affirmation library
• Exclusive categories and themes
• Additional Mint capacity
• Premium appearance options

7.3 Pricing & Billing

• Pricing, billing cadence, and benefits are clearly disclosed inside the App at the point of purchase, in your local currency where supported by Apple
• All charges are made by Apple to your Apple ID
• Subscriptions auto-renew at the end of each period unless you cancel at least 24 hours before the renewal date
• Free-trial periods, if offered, convert to paid subscriptions at the end of the trial unless canceled before that time

7.4 Managing Your Subscription

You can manage, change, or cancel your Wealthy Vault subscription at any time in Settings → Apple ID → Subscriptions. Canceling stops the next renewal but leaves your access active for the remainder of the paid period.

7.5 Refunds

Because all transactions are processed by Apple, refund requests must be made through Apple at reportaproblem.apple.com. Believe PR cannot directly issue Apple App Store refunds.

7.6 Price Changes

We may change subscription prices over time. Apple will notify existing subscribers of any material price increase and request consent as required by the App Store rules of your region.

8. Not Financial, Therapy, or Medical Advice

8.1 What Wealthy Is Not

Wealthy does NOT provide:

• Personalized investment, tax, or financial-planning advice
• Recommendations to buy, sell, or hold any security, asset, or product
• Guarantees of income, returns, or any specific financial outcome
• Medical diagnosis or treatment
• Mental-health therapy or counseling
• Crisis intervention services
• Personalized clinical or legal advice from a licensed professional

8.2 Affirmations Are Inspiration, Not Predictions

Affirmations are statements of intention and identity. They are not predictions, forecasts, or commitments — neither by you, nor by us, nor by any third party. Wealth outcomes depend on factors entirely outside the App.

8.3 If You Are in Crisis

If you are experiencing a mental-health emergency, please contact a qualified professional or emergency services in your country. In the United States, you can call or text 988 to reach the Suicide & Crisis Lifeline, or text HOME to 741741 for the Crisis Text Line. Internationally, visit findahelpline.com.

8.4 User Responsibility

You acknowledge and agree that:

• You use Wealthy at your own discretion and risk
• Affirmations are inspirational content, not personalized advice
• You are responsible for any financial decisions you make, and for seeking appropriate professional care when needed

9. Intellectual Property

9.1 Ownership

All intellectual property rights in and to Wealthy, including but not limited to:

• The Wealthy source code, application binary, and design
• The Wealthy name, logo, gold-coin mark, treasury-key mark, and the "Mint" feature name
• The Wealthy visual design system, color palettes, and typography choices
• The bundled affirmation content as a curated collection
• The text of these Terms and the Privacy Policy

...are owned exclusively by Believe PR and Armando Jimenez.

9.2 Trademarks

"Wealthy," "Wealthy Vault," "Mint" (as used inside Wealthy), and associated logos and marks are trademarks of Believe PR. You may not use these marks without prior written permission.

9.3 User Content

You retain ownership of:

• Affirmations you write yourself
• Custom theme photos you supply
• The contents of your Vault, hidden list, and history (as data on your device)

Because this data is stored locally and never transmitted to our servers, Believe PR claims no ownership and no license over it.

9.4 Copyright Concerns

If you believe content in Wealthy infringes your copyright, contact us at wealthy@armandojimenez.dev with sufficient detail to identify the work in question.

10. Prohibited Uses

You agree NOT to use Wealthy to:

10.1 Illegal or Harmful Activities

• Engage in any activity that violates local, state, national, or international law
• Harass, stalk, threaten, or harm any other person
• Create or distribute hateful, violent, sexual, or otherwise harmful content
• Generate financial scams, fraudulent solicitations, or pyramid / multi-level recruitment material

10.2 Unauthorized Access

• Reverse engineer, decompile, or modify the App
• Bypass security measures, content filters, rate limits, or Wealthy Vault entitlement checks
• Probe, scan, or test the AI Gateway for vulnerabilities

10.3 Commercial Misuse

• Resell, rent, or redistribute the App, the bundled content, or Wealthy Vault access
• Use Mint as a backend for another product or service
• Scrape or extract Wealthy's content programmatically

10.4 Malicious Activity

• Upload malware, viruses, or malicious code
• Disrupt the proper functioning of the App or AI Gateway
• Attempt to overload, throttle, or crash the AI Gateway or any provider it routes to

11. Termination

11.1 Termination by You

You may stop using Wealthy at any time by:

• Uninstalling Wealthy from all of your devices
• Canceling your Wealthy Vault subscription in Settings → Apple ID → Subscriptions
• Deleting your Wealthy data from iCloud (if iCloud sync was enabled)

11.2 Termination by Us

We reserve the right to:

• Discontinue Wealthy at any time
• Block access to Mint if these Terms are violated
• Revoke Wealthy Vault entitlements obtained through fraud, chargeback, or violation of these Terms
• Remove the App from the App Store
• Disable specific features or content

11.3 Effect of Termination

Upon termination:

• Your license to use Wealthy immediately ends
• You must stop using the App
• Any prepaid, unused portion of a Wealthy Vault subscription remains subject to Apple's refund policies
• Provisions regarding intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution survive termination

12. Disclaimers

12.1 "AS IS" and "AS AVAILABLE"

WEALTHY IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY
• UNINTERRUPTED OR ERROR-FREE OPERATION

12.2 No Guarantee of Outcome

WE DO NOT WARRANT THAT:

• Affirmations or AI generations will be accurate, complete, or appropriate for any specific situation
• Use of Wealthy will lead to any specific financial, professional, or personal outcome
• Wealthy or Mint will be available at any particular time
• Bugs or errors will be corrected
• Wealthy will be compatible with all devices or future iOS versions
• iCloud sync will be free of conflicts or data loss

12.3 Third-Party Services

WE ARE NOT RESPONSIBLE FOR:

• The availability or behavior of Cloudflare Workers
• The availability, output, or policies of xAI, OpenRouter, or any other AI provider
• RevenueCat's availability or its handling of subscription state
• Apple iCloud, CloudKit, StoreKit, or App Store availability
• Device operating system issues, network outages, or other infrastructure failures

12.4 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of implied warranties. In those jurisdictions, the above exclusions may not apply to you, and you may have additional rights.

13. Limitation of Liability

13.1 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BELIEVE PR, ARMANDO JIMENEZ, OR THEIR AFFILIATES BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• LOSS OF PROFITS, REVENUE, OR BUSINESS OPPORTUNITIES
• LOSS OF DATA OR INFORMATION (INCLUDING ANY VAULT CONTENT)
• FINANCIAL LOSS OR INVESTMENT DECISIONS INFLUENCED IN ANY WAY BY AFFIRMATION CONTENT
• EMOTIONAL DISTRESS OR PERSONAL HARM ALLEGED TO ARISE FROM AFFIRMATION CONTENT
• COST OF SUBSTITUTE GOODS OR SERVICES

13.2 Cap on Liability

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO WEALTHY SHALL NOT EXCEED THE GREATER OF:

• USD $50
• The total amount you have paid to use Wealthy in the twelve (12) months preceding the claim

13.3 Basis of the Bargain

These limitations reflect the allocation of risk between you and Believe PR and are an essential basis of this agreement, which would not be offered without them.

13.4 Jurisdictional Exceptions

Some jurisdictions do not allow limitations on liability for certain types of damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

14. Indemnification

14.1 Your Indemnification

You agree to indemnify, defend, and hold harmless Believe PR, Armando Jimenez, and their affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of Wealthy or Mint
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Your violation of the rights of any third party (including content you submit to Mint)
• Any financial decision you make based, in whole or in part, on content shown by Wealthy

14.2 Defense of Claims

We reserve the right to assume exclusive defense and control of any matter subject to indemnification. You agree to cooperate with us in defending such claims.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Puerto Rico, without regard to its conflict of law provisions.

15.2 Jurisdiction

You agree that any legal action or proceeding arising from these Terms shall be brought exclusively in the courts of the Commonwealth of Puerto Rico, and you consent to the personal jurisdiction of such courts.

15.3 Informal Resolution First

Before filing any legal action, you agree to attempt to resolve disputes informally by emailing wealthy@armandojimenez.dev and allowing 30 days for a good-faith response.

15.4 Class Action Waiver

TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE SHALL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION.

15.5 Consumer Rights

Nothing in these Terms limits your statutory rights as a consumer under applicable consumer protection laws.

16. Changes to Terms

16.1 Right to Modify

We reserve the right to modify these Terms at any time to reflect new features, legal requirements, or changes in business practices.

16.2 Notice of Changes

When we make material changes:

• The "Last Updated" date will be revised
• You may receive an in-app notice the next time you open Wealthy

16.3 Acceptance of Changes

By continuing to use Wealthy after changes are posted, you accept the modified Terms. If you disagree with any change, you must stop using Wealthy.
