1. Acceptance of Terms

Welcome to 369 Daily ("the App"), developed and operated by Believe PR, owned by Armando Jimenez. By downloading, installing, accessing, or using the App, you ("User," "you," or "your") agree to be bound by these Terms and Conditions ("Terms").

1.1 Agreement to Terms

These Terms constitute a legally binding agreement between you and Believe PR. By using the App, you represent that:

• You are at least 13 years of age (or the minimum age required in your jurisdiction)
• You have the legal capacity to enter into these Terms
• If you are under 18, you have obtained parental or guardian consent
• You will comply with all applicable laws and regulations

• Apple App Store Terms of Service (iOS users)
• Google Play Store Terms of Service (Android users)
• RevenueCat Terms of Service (subscription management)

2. App Description

2.1 Purpose

369 Daily is a manifestation and mindfulness application based on the 369 method — inspired by Nikola Tesla's fascination with the numbers 3, 6, and 9. The App is designed to help users:

• Practice the 369 writing method — write your affirmation 3 times in the morning, 6 times in the afternoon, and 9 times in the evening
• Build a consistent daily manifestation ritual through structured repetition
• Cultivate mindfulness, intentionality, and personal growth
• Track progress and maintain motivation over 33-day and 45-day manifestation cycles

2.2 Key Features

• 369 Writing Method: Guided sessions for writing affirmations 3 times in the morning, 6 times in the afternoon, and 9 times in the evening
• Manifestation Cycles: 33-day and 45-day structured manifestation programs
• Session-Aware Themes: Dynamic color themes that change based on time of day (morning, afternoon, evening)

2.3 Data Storage

• All data is stored locally on your device only
• No user accounts are required to use the App
• Your affirmations and personal data never leave your device

2.4 Availability

• The App is available for iOS and Android devices
• Certain features may vary by platform
• We reserve the right to modify or discontinue features at any time

3. License to Use

3.1 License Grant

Subject to your compliance with these Terms, Believe PR grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on devices you own or control
• Access and use the App for personal, non-commercial purposes
• Use all features and functionalities as intended

3.2 License Restrictions

You may NOT:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove or modify any copyright, trademark, or proprietary notices
• Rent, lease, lend, sell, or sublicense the App
• Use the App for any commercial purpose without written permission
• Circumvent any security features or access restrictions
• Use automated tools to access or interact with the App

3.3 Ownership

The App and all intellectual property rights remain the exclusive property of Believe PR and Armando Jimenez. This license does not grant you any ownership rights.

4. User Obligations

4.1 Responsible Use

You agree to:

• Use the App in accordance with these Terms and applicable laws
• Understand that the 369 method is a mindfulness and personal development practice
• Not rely on the App as a substitute for professional advice of any kind
• Keep your device secure and protect your saved data
• Not use the App for any unlawful or fraudulent purposes

4.2 Device Security

Although the App does not require user accounts:

• You are responsible for securing your device
• Protect your saved affirmations and data from unauthorized access
• Back up your device regularly, as local data may be lost if the App is uninstalled

4.3 Prohibited Conduct

You agree NOT to:

• Use the App to create, store, or share harmful or offensive content
• Share or distribute the App outside official app stores
• Attempt to gain unauthorized access to premium features
• Interfere with the proper functioning of the App
• Upload malware or malicious code

5. Manifestation Disclaimer

The 369 method practiced within 369 Daily is a mindfulness and visualization exercise. It is rooted in the practice of intentional repetition and focused thought. You acknowledge and agree that:

• The 369 method is a personal development and mindfulness practice, NOT a guaranteed path to any specific outcome
• The App does NOT guarantee any specific results, manifestations, or life changes
• Affirmations written in the App are personal exercises intended for self-reflection and positive thinking
• The App is NOT a substitute for medical, psychological, psychiatric, financial, or any other professional advice or treatment
• Results vary significantly and depend entirely on individual commitment, circumstances, and perspective
• The App is provided for personal growth and entertainment purposes
• No scientific claims are made regarding the efficacy of the 369 method or manifestation practices in general
• You should seek qualified professional help for medical, mental health, financial, or legal concerns

6. In-App Purchases & Subscriptions

6.1 369 Daily Pro Subscription

The App offers a premium subscription ("369 Daily Pro") with the following details:

• Type: Auto-renewable subscription (monthly or yearly) and a lifetime purchase option
• Benefits: Unlimited manifestation cycles, custom themes, configurable session windows, affirmation in notifications, ability to edit affirmations mid-cycle, and additional premium features
• Billing: Charged to your Apple ID or Google Play account
• Renewal: Automatically renews unless cancelled at least 24 hours before the current period ends
• Cancellation: Manage subscriptions in your App Store or Play Store settings at any time
• Lifetime Option: A one-time purchase that grants permanent access to all premium features

6.2 Payment Processing

• All purchases are processed through Apple App Store or Google Play Store
• Subscription management is handled by RevenueCat
• Pricing is set in your local currency
• Payment is charged to your App Store or Play Store account
• We do not have access to your payment information

6.3 Refund Policy

Non-Refundable Purchases: All in-app purchases are final and non-refundable, except as required by applicable law.

Exceptions:

• Technical Issues: If the purchase does not unlock premium features, contact us for support
• Accidental Purchases: Refund requests must be made through Apple or Google within their refund windows
• Legal Requirements: Refunds as required by consumer protection laws in your jurisdiction

6.4 Subscription Terms

Auto-Renewal: Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the period ends. You can manage auto-renewal in your account settings.

Price Changes: We reserve the right to change subscription prices with advance notice. Changes apply to new billing periods only.

Access Upon Cancellation: If you cancel, you retain premium access until the end of the current billing period.

7. Intellectual Property

7.1 Ownership

All intellectual property rights in and to the App, including but not limited to:

• Source code and software
• User interface and design
• Graphics, logos, and icons
• Text, content, and documentation
• Session-aware themes and visual assets
• Trademarks and brand names

7.2 Trademarks

"369 Daily" and associated logos are trademarks of Believe PR. You may not use these marks without prior written permission.

7.3 User Content

You retain ownership of:

• Your personal affirmations and written content
• Your manifestation cycle history and progress data
• Reflection entries and customization choices
• Exported affirmation images you create

Since all data is stored locally on your device and never transmitted to our servers, we claim no ownership or rights to your content.

8. Prohibited Uses

You agree NOT to use the App for:

8.1 Illegal Activities

• Fraud or misrepresentation
• Creating or distributing harmful, threatening, or offensive content
• Any activity that violates local, state, or federal laws
• Harassment or intimidation of others

8.2 Unauthorized Access

• Hacking or cracking the App
• Bypassing security measures or subscription verification
• Accessing premium features without authorization
• Reverse engineering the App code

8.3 Commercial Exploitation

• Reselling or redistributing the App
• Using the App as part of a commercial service without permission
• Incorporating the App into other products
• Scraping or extracting App content

8.4 Harmful Activities

• Uploading malware or viruses
• Disrupting App functionality
• Interfering with other users' experience
• Attempting to overload or crash servers

9. Termination

9.1 Termination by You

You may terminate this agreement at any time by:

• Uninstalling the App from all devices
• Deleting all saved data
• Ceasing all use of the App

9.2 Termination by Us

We reserve the right to:

• Discontinue the App at any time
• Block access if Terms are violated
• Remove the App from app stores
• Disable features or functionality

9.3 Effect of Termination

Upon termination:

• Your license to use the App immediately ends
• You must cease all use of the App
• You should delete the App and all data
• All affirmations, cycles, and progress data are permanently deleted
• Provisions regarding disclaimers, liability, and indemnification survive

9.4 No Refunds on Termination

We are not obligated to provide refunds if:

• You voluntarily uninstall the App
• We terminate your access due to Terms violations
• The App is discontinued (unless required by law)

10. Disclaimers

10.1 "AS IS" and "AS AVAILABLE"

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY
• UNINTERRUPTED OR ERROR-FREE OPERATION

10.2 No Guarantee of Results

WE DO NOT WARRANT THAT:

• The 369 method or any manifestation practice will produce specific results
• The App will meet your specific requirements or expectations
• Affirmation writing will lead to any particular outcome
• All features will function perfectly at all times
• Bugs or errors will be corrected
• The App will be compatible with all devices

10.3 Not Professional Advice

WE ARE NOT RESPONSIBLE FOR:

• Decisions made based on affirmations or manifestation practices
• Any real-world outcomes attributed to using the App
• Medical, psychological, financial, or legal consequences
• Loss of data, affirmations, or progress records
• Consequences of relying on the App for personal guidance

10.4 Third-Party Services

WE ARE NOT RESPONSIBLE FOR:

• Apple App Store or Google Play Store policies
• RevenueCat subscription management
• Device operating system issues
• Internet connectivity problems
• Third-party services integrated with the App

10.5 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of implied warranties. In such jurisdictions, the above exclusions may not apply to you, and you may have additional rights.

11. Limitation of Liability

11.1 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BELIEVE PR, ARMANDO JIMENEZ, OR THEIR AFFILIATES BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• LOSS OF PROFITS, REVENUE, OR BUSINESS OPPORTUNITIES
• LOSS OF DATA OR INFORMATION
• COST OF SUBSTITUTE GOODS OR SERVICES
• PERSONAL INJURY OR PROPERTY DAMAGE

11.2 Cap on Liability

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE GREATER OF:

• $50 USD (or equivalent in your local currency)
• The amount you paid for the subscription (if applicable)

11.3 Basis of the Bargain

These limitations reflect the allocation of risk between the parties. The App is offered at a nominal price (or free), and the limitations are an essential basis of the agreement.

11.4 Jurisdictional Exceptions

Some jurisdictions do not allow limitations on liability for certain types of damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

12. Indemnification

12.1 Your Indemnification

You agree to indemnify, defend, and hold harmless Believe PR, Armando Jimenez, and their affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Your violation of any third-party rights
• Any decisions made based on affirmations or manifestation practices within the App
• Any claims that the App caused specific real-world outcomes

12.2 Defense of Claims

We reserve the right to:

• Assume exclusive defense and control of any matter subject to indemnification
• Cooperate with you in defending such claims
• Settle claims at our discretion

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Puerto Rico, without regard to its conflict of law provisions.

13.2 Jurisdiction

You agree that any legal action or proceeding arising from these Terms shall be brought exclusively in the courts of Puerto Rico, and you consent to the jurisdiction of such courts.

13.3 Dispute Resolution

Before filing any legal action, you agree to attempt to resolve disputes through:

• Good Faith Discussion: Allow 30 days for resolution attempts
• Mediation: Consider voluntary mediation if informal resolution fails

13.4 Class Action Waiver

TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE SHALL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION.

13.5 Consumer Rights

Nothing in these Terms limits your statutory rights as a consumer under applicable consumer protection laws.

14. Changes to Terms

14.1 Right to Modify

We reserve the right to modify these Terms at any time. Changes may be made to reflect:

• New features or functionality
• Legal or regulatory requirements
• Business practices changes
• User feedback and concerns

14.2 Notice of Changes

When we make significant changes:

• The "Last Updated" date will be revised
• You may receive an in-app notification
• Material changes will be highlighted

14.3 Acceptance of Changes

By continuing to use the App after changes are posted:

• You accept the modified Terms
• The new Terms become effective immediately
• If you disagree, you must stop using the App
