1. Acceptance of Terms

Welcome to Dear Cosmos ("the App"), developed and operated by Believe PR, owned by Armando Jimenez. By downloading, installing, accessing, or using the App, you ("User," "you," or "your") agree to be bound by these Terms and Conditions ("Terms").

1.1 Agreement to Terms

These Terms form a legally binding agreement between you and Believe PR. By using Dear Cosmos, you represent that:

• You are at least 13 years of age (or the minimum age required by your jurisdiction)
• You have the legal capacity to enter into these Terms
• If you are under 18, you have obtained parental or guardian consent
• You will comply with all applicable laws and regulations

1.2 Additional Terms

In addition to these Terms, your use of Dear Cosmos is also governed by:

• Our Privacy Policy
• The App Store or Google Play terms for your platform
• The terms of the AI provider that your question is routed to (Cloudflare and OpenRouter)

2. App Description

2.1 Purpose

Dear Cosmos is a cross-platform (iOS and Android) reflective companion that lets you:

• Ask the universe a question and receive an answer written in its own first-person voice
• Choose a voice (tone) that shapes how the answer feels
• Watch a living, tone-reactive cosmos and receive a small cosmic sign with each answer
• Keep your questions and answers in a private journal, "Your Cosmos"
• Receive an optional gentle daily message
• Add a home-screen widget that surfaces your latest sign

2.2 Key Features

• Ask: A question, a chosen voice, and an answer composed in real time
• Your Cosmos: Your private, on-device journal of past questions, answers, and signs
• Cosmic Sign: A small symbol and affirmation that accompanies each answer
• Share: An optional, beautifully rendered card you can share from your device
• Daily Message: One gentle local notification, if you turn it on
• Widget: Your latest sign on the home screen
• Appearance: Deep Void and Daybreak themes, both languages (English and Spanish)

2.3 Availability

• Dear Cosmos is available on iOS and Android
• Asking a question requires an internet connection. Your journal, your saved answers, the daily message, and the widget continue to work offline
• We reserve the right to modify, add, or discontinue features at any time

3. License to Use

3.1 License Grant

Subject to your compliance with these Terms, Believe PR grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install Dear Cosmos on devices you own or control
• Access and use Dear Cosmos for personal, non-commercial purposes
• Use all features and functionalities as intended

3.2 License Restrictions

You may NOT:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove or modify any copyright, trademark, or proprietary notices
• Rent, lease, lend, sell, or sublicense the App
• Use the App for any commercial purpose without written permission
• Circumvent any security features or rate limits, including those of the AI Gateway
• Use automated tools, scripts, or bots to interact with Dear Cosmos or its Gateway

3.3 Ownership

Dear Cosmos and all of its intellectual property rights remain the exclusive property of Believe PR and Armando Jimenez. This license does not grant you any ownership rights in the App.

4. User Obligations

4.1 Responsible Use

You agree to:

• Use Dear Cosmos in accordance with these Terms and applicable laws
• Ask questions in good faith, for personal reflection
• Keep your device secure
• Not use Dear Cosmos for any unlawful, harmful, or deceptive purpose

4.2 No Account, Your Responsibility

Dear Cosmos does not require an account. Because all of your data lives on your device, you are responsible for:

• Securing your device
• Understanding that uninstalling Dear Cosmos will permanently delete your local journal, as there is no cloud backup

5. Your Questions & Answers

5.1 Your Content

You retain full ownership of the questions you write and the answers you keep in "Your Cosmos." Because that content lives only on your device, Believe PR does not claim, license, or moderate it, and we never receive a copy of your journal.

5.2 Shared Cards

You may use Dear Cosmos to render a card from an answer and share it. Once you share that card outside the App (for example, by sending it through another app or saving it elsewhere), it becomes subject to the terms and policies of that other service.

6. The AI Feature

6.1 What It Is

Answers in Dear Cosmos are composed by a large language model. Your question is routed through an AI Gateway (Cloudflare Workers) to a model provider (currently OpenRouter, routing to DeepSeek V4 Flash).

6.2 Acceptable Use

You agree NOT to use the App to:

• Generate hateful, violent, sexual, harassing, or otherwise harmful content
• Generate content about other identifiable individuals without their consent
• Attempt to extract system prompts, model weights, or training data
• Probe, attack, or attempt to bypass safety filters or rate limits
• Use answers as a substitute for emergency, medical, legal, or financial advice
• Submit personally identifying information about yourself or others (full names, addresses, account numbers, government IDs, or medical records)

6.3 Rate Limits & Fair Use

To keep the App available to everyone, the AI Gateway enforces per-device and per-IP rate limits (subject to change). Excessive or abusive use may be temporarily or permanently blocked at the Gateway level.

6.4 No Guarantees on Output

6.5 Service Availability

Asking a question depends on third-party providers and may be temporarily unavailable due to provider outages, network issues, content filtering, or rate limits. The rest of Dear Cosmos (your journal, your daily message, your widget) continues to work without an internet connection.

7. Not Fortune-Telling or Professional Advice

7.1 What Dear Cosmos Is Not

Dear Cosmos does NOT provide:

• Predictions of the future, fortune-telling, or astrological readings
• Medical diagnosis or treatment
• Mental-health therapy, counseling, or crisis intervention
• Personalized financial, investment, tax, or legal advice
• Guarantees of any specific outcome in your life

7.2 Answers Are Reflection, Not Prediction

The answers and signs in Dear Cosmos are creative, first-person reflections meant to encourage wonder and self-reflection. They are not predictions, forecasts, or commitments, by you, by us, or by any third party. Outcomes in your life depend on factors entirely outside the App.

7.3 If You Are in Crisis

If you are experiencing a mental-health emergency or are in crisis, please reach out to a trained human right away. Visit findahelpline.com to find a free, confidential helpline in your country, or contact your local emergency services.

7.4 User Responsibility

You acknowledge and agree that:

• You use Dear Cosmos at your own discretion and risk
• Answers are inspirational and creative content, not personalized advice
• You are responsible for your own decisions, and for seeking appropriate professional care when needed

8. Intellectual Property

8.1 Ownership

All intellectual property rights in and to Dear Cosmos, including but not limited to:

• The Dear Cosmos source code, application binary, and design
• The Dear Cosmos name, wordmark, cosmic sign marks, and "Luminous Line" visual system
• The color palettes, typography choices, and the procedural cosmos engine
• The text of these Terms and the Privacy Policy

...are owned exclusively by Believe PR and Armando Jimenez.

8.2 Trademarks

"Dear Cosmos" and associated logos and marks are trademarks of Believe PR. You may not use these marks without prior written permission.

8.3 Your Content

You retain ownership of the questions you write and the answers you keep. Because this data is stored locally and never transmitted to our servers, Believe PR claims no ownership and no license over it.

8.4 Copyright Concerns

If you believe content in Dear Cosmos infringes your copyright, contact us at dearcosmos@armandojimenez.dev with sufficient detail to identify the work in question.

9. Prohibited Uses

You agree NOT to use Dear Cosmos to:

9.1 Illegal or Harmful Activities

• Engage in any activity that violates local, state, national, or international law
• Harass, stalk, threaten, or harm any other person
• Create or distribute hateful, violent, sexual, or otherwise harmful content

9.2 Unauthorized Access

• Reverse engineer, decompile, or modify the App
• Bypass security measures, content filters, or rate limits
• Probe, scan, or test the AI Gateway for vulnerabilities

9.3 Commercial Misuse

• Resell, rent, or redistribute the App
• Use the AI Gateway as a backend for another product or service
• Scrape or extract the App's content programmatically

9.4 Malicious Activity

• Upload malware, viruses, or malicious code
• Disrupt the proper functioning of the App or AI Gateway
• Attempt to overload, throttle, or crash the AI Gateway or any provider it routes to

10. Termination

10.1 Termination by You

You may stop using Dear Cosmos at any time by uninstalling it from all of your devices. This permanently removes your local data.

10.2 Termination by Us

We reserve the right to:

• Discontinue Dear Cosmos at any time
• Block access to the AI Gateway if these Terms are violated
• Remove the App from the App Store or Google Play
• Disable specific features or content

10.3 Effect of Termination

• Your license to use Dear Cosmos immediately ends
• You must stop using the App
• Provisions regarding intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution survive termination

11. Disclaimers

11.1 "AS IS" and "AS AVAILABLE"

DEAR COSMOS IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY
• UNINTERRUPTED OR ERROR-FREE OPERATION

11.2 No Guarantee of Outcome

WE DO NOT WARRANT THAT:

• Answers or AI generations will be accurate, complete, or appropriate for any specific situation
• Use of Dear Cosmos will lead to any specific personal, emotional, or material outcome
• The App or its AI feature will be available at any particular time
• Bugs or errors will be corrected
• Dear Cosmos will be compatible with all devices or future operating-system versions

11.3 Third-Party Services

WE ARE NOT RESPONSIBLE FOR:

• The availability or behavior of Cloudflare Workers
• The availability, output, or policies of OpenRouter or any other AI provider
• Apple App Store or Google Play availability
• Device operating-system issues, network outages, or other infrastructure failures

11.4 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of implied warranties. In those jurisdictions, the above exclusions may not apply to you, and you may have additional rights.

12. Limitation of Liability

12.1 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BELIEVE PR, ARMANDO JIMENEZ, OR THEIR AFFILIATES BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• LOSS OF PROFITS, REVENUE, OR BUSINESS OPPORTUNITIES
• LOSS OF DATA OR INFORMATION (INCLUDING ANY JOURNAL CONTENT)
• DECISIONS INFLUENCED IN ANY WAY BY ANSWER OR SIGN CONTENT
• EMOTIONAL DISTRESS OR PERSONAL HARM ALLEGED TO ARISE FROM APP CONTENT
• COST OF SUBSTITUTE GOODS OR SERVICES

12.2 Cap on Liability

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO DEAR COSMOS SHALL NOT EXCEED THE GREATER OF:

• USD $50
• The total amount you have paid to use Dear Cosmos in the twelve (12) months preceding the claim

12.3 Basis of the Bargain

These limitations reflect the allocation of risk between you and Believe PR and are an essential basis of this agreement, which would not be offered without them.

12.4 Jurisdictional Exceptions

Some jurisdictions do not allow limitations on liability for certain types of damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

13. Indemnification

13.1 Your Indemnification

You agree to indemnify, defend, and hold harmless Believe PR, Armando Jimenez, and their affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of Dear Cosmos or its AI feature
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Your violation of the rights of any third party (including content you submit)

13.2 Defense of Claims

We reserve the right to assume exclusive defense and control of any matter subject to indemnification. You agree to cooperate with us in defending such claims.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Puerto Rico, without regard to its conflict of law provisions.

14.2 Jurisdiction

You agree that any legal action or proceeding arising from these Terms shall be brought exclusively in the courts of the Commonwealth of Puerto Rico, and you consent to the personal jurisdiction of such courts.

14.3 Informal Resolution First

Before filing any legal action, you agree to attempt to resolve disputes informally by emailing dearcosmos@armandojimenez.dev and allowing 30 days for a good-faith response.

14.4 Class Action Waiver

TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE SHALL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION.

14.5 Consumer Rights

Nothing in these Terms limits your statutory rights as a consumer under applicable consumer-protection laws.

15. Changes to Terms

15.1 Right to Modify

We reserve the right to modify these Terms at any time to reflect new features, legal requirements, or changes in business practices.

15.2 Notice of Changes

When we make material changes:

• The "Last Updated" date will be revised
• You may receive an in-app notice the next time you open Dear Cosmos

15.3 Acceptance of Changes

By continuing to use Dear Cosmos after changes are posted, you accept the modified Terms. If you disagree with any change, you must stop using the App.
