Terms of Service

1. Agreement and eligibility

These Terms govern your use of Inscrybe, provided by Believe PR, owned by Armando Jimenez, in Puerto Rico (“we,” “us”). By using the application, you agree to these Terms to the extent a binding agreement is permitted by applicable law. If you do not agree, stop using it. Contact us at inscrybe@armandojimenez.dev.

Inscrybe is a general-audience audio tool. You must be legally able to enter this agreement, or use the application with the permission and supervision of a parent or legal guardian where required. Any minimum age, consent rule or other restriction imposed by your local law still applies. The App Store’s rating describes app content; it does not guarantee the suitability of files you import.

2. What Inscrybe provides

Inscrybe lets you import and play audio, organize a library, mix layers, record a voice, render text with system voices, use bundled affirmations and sounds, and create audio or visual exports. Features depend on your version, device, permissions, available services and, for some, an Inscrybe Deep subscription. iCloud synchronization is optional.

Inscrybe is a creation and playback tool, not a music-streaming service, public content marketplace or rights-clearance service. It does not host a public feed of users’ recordings. A feature’s technical ability to read, download, convert or export a file does not establish permission to do so.

3. Your files, downloads and copyright

• Use material you own, have permission to use, or may lawfully use under an applicable license or legal exception. Follow attribution, noncommercial, share-alike and other relevant conditions.
• Music may involve separate rights in the recording and the underlying composition or lyrics. Photos, artwork, video, scripts, affirmations and recorded voices can carry their own rights.
• Buying a song, paying for a streaming service, finding a download link, giving credit, keeping only a short excerpt or calling a work “subliminal” does not by itself authorize reuse, adaptation, distribution or commercial publication.
• Mixing, masking, looping, changing speed or pitch, converting formats, making an ultrasonic version or adding affirmations does not remove copyright or automatically make a use lawful.
• Do not bypass DRM, paywalls or access restrictions, scrape or download contrary to a provider’s applicable terms, or use Inscrybe to infringe copyright or other rights. The direct-file importer is not authorization to extract material from streaming services.
• Obtain any required consent for recording people and using their voice, name, likeness or personal information. Do not impersonate, harass or publish intimate or private material without permission.

We do not select, license, endorse or verify the legality of your imported content. You are responsible for your choices and resulting uses. To the extent permitted by law, Believe PR and Armando Jimenez are not responsible for infringement or other unlawful conduct resulting from content you supply or uses you make of it. This does not exclude duties or liability the law places on us.

If you are unsure whether a use is permitted, obtain permission or appropriate advice before proceeding. Inscrybe does not determine whether your use qualifies as fair use or another exception.

4. Ownership, app license and bundled material

You retain the rights you already hold in your original recordings, scripts and other content. Inscrybe does not acquire ownership of them. Exporting a mix does not give you ownership of third-party ingredients. Processing and optional synchronization require the permissions necessary to perform the features you request; these Terms do not grant us a general right to publish your private creations.

We grant you a limited, nonexclusive right to use Inscrybe on compatible Apple devices you own or control, subject to these Terms and Apple’s usage rules. The application, brand and bundled materials remain ours or their respective licensors’. Do not redistribute or sell the application or extract its bundled library as a competing sound or affirmation collection. Applicable open-source licenses, identified in Acknowledgements, retain their own terms and rights.

Bundled material is provided for use through the app’s supported features, subject to any identified license restrictions. We do not grant rights we do not hold. For external publication or commercial distribution, verify the rights to every element, including third-party photos and system-generated speech. Unsplash images remain subject to the Unsplash License and Terms. Apple’s voice and software licenses may limit use of generated speech; an Export button is not a commercial voice license.

5. Listening, visuals and no promised results

Inscrybe is not a medical device, treatment or professional health service. Affirmations, subliminal audio, binaural sounds and Visuals are offered as creative and personal-use tools. We do not promise subconscious changes, healing, body changes, wealth, relationships, manifestation outcomes or any other result. Do not replace professional care or prescribed treatment with the application.

Use a comfortable volume and take breaks. Boosted, layered or high-frequency audio can be loud even when a voice seems inaudible. Do not raise the volume to try to hear an ultrasonic layer. Stop if you experience discomfort. Do not use distracting visuals, sleep-oriented sessions or headphones in a way that interferes with safe driving, operating machinery or awareness of your surroundings. Flashing visuals can affect photosensitive people; heed the app’s warnings and choose nonflashing options when appropriate.

Review the material you play or share. Do not expose others to hidden messages, recordings or potentially harmful content without their knowledge and appropriate consent.

6. Inscrybe Deep and purchases

Inscrybe is free to download. Inscrybe Deep is an optional auto-renewing subscription, monthly or yearly, that unlocks the features shown on its purchase screen. Prices are set by country and shown in the app from the App Store, in your currency, before you confirm. The yearly plan includes a free trial for people who are eligible; the purchase screen says so when it applies.

Payment is charged to your Apple Account when you confirm the purchase, or when the free trial ends. A subscription renews automatically for the same period at the price then in effect unless auto-renew is turned off at least 24 hours before the current period ends; the renewal is charged within the 24 hours before the period ends. Manage or cancel it in your Apple Account’s Subscriptions settings, or with Manage Subscription in Inscrybe’s Settings. Canceling stops the next renewal, and you keep access until the end of the period already paid for. Canceling a free trial at least 24 hours before it ends means no charge. Any unused part of a free trial ends when you buy a subscription. Deleting the app or its data does not cancel a subscription.

Family Sharing is available: the family organizer’s subscription can be shared with up to five family members through Apple. Restore Purchases in Settings brings a subscription back on a new device or after reinstalling, with the same Apple Account.

When a subscription ends, nothing you made is deleted. The subscription’s features lock until you subscribe again: Studio projects are kept and can be deleted but not opened, Mixes play but can’t be edited, iCloud Sync pauses where it stopped, and themes show your free choice. What you disguised or hid stays that way.

Apple processes billing and refund requests under its rules and applicable consumer law. See Apple’s refund-request service. We do not limit mandatory refund, withdrawal or other consumer rights. Prices, plans and the features included may change; a price change to an active subscription follows Apple’s rules, including any consent Apple requires.

7. Other services, backups and availability

Apple services, iCloud, Unsplash, file hosts and applications you share to have their own terms. You are responsible for compliance with the terms that apply to your use. We do not control their availability, content, storage limits or decisions. We may change or discontinue features, subject to notice, refund and other obligations imposed by law.

Keep independent backups of important content. Sync, conversion, export, recovery and timers can fail or be interrupted by device, network, storage or operating-system conditions. Verify important exports before deleting originals. We do not guarantee permanent storage, uninterrupted background playback, a particular voice’s availability or recovery of a lost PIN, recovery code or file.

App Lock, Discreet Mode and Hidden are privacy conveniences with the limits described in the application. They do not guarantee secrecy from someone with access to your device, cloud account, backups or shared copies. The Privacy Policy explains data handling.

8. Acceptable use and infringement reports

Do not use Inscrybe unlawfully, interfere with services or security, distribute malware, infringe rights, create abusive or deceptive material, or exploit another person. Do not reverse engineer or circumvent technical restrictions except where applicable law or an open-source license expressly permits it.

Report a suspected infringement involving material we provide to inscrybe@armandojimenez.dev. Identify the protected work, the allegedly infringing material and its location, your contact details and the basis for your claim. We will investigate notices and act where appropriate. We do not claim to monitor private libraries or to be able to remove content from another person’s device or a third-party service. Contact the host responsible for externally published material as well.

9. Warranties and responsibility

To the extent permitted by law, Inscrybe is provided “as is” and “as available,” without additional promises of merchantability, fitness for a particular purpose, noninfringement of user-supplied content, error-free operation or specific results. You choose the files, settings, listening levels and destinations you use. We cannot warrant the safety, accuracy or legality of material supplied by you or third parties.

These statements do not exclude statutory guarantees, our express commitments, or obligations that cannot lawfully be excluded.

10. Limits of liability and third-party claims

To the extent allowed by applicable law, we are not liable for indirect or consequential losses, lost profits, or loss of content arising from your use or inability to use the app, third-party service failures, or unlawful use of user-supplied material. Where a monetary cap is lawful, our total liability arising from the app is limited to the greater of US$100 or the amount you paid for Inscrybe during the twelve months preceding the event giving rise to the claim.

These exclusions and the cap do not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by our negligence, or any other liability or consumer right that cannot legally be excluded or limited. Local law may give you additional remedies.

To the extent permitted by law, you agree to indemnify Believe PR and Armando Jimenez for reasonable third-party claims, damages and costs, including reasonable legal fees, caused by your unlawful use, your violation of another person’s rights, or your material breach of these Terms. This applies only to the extent attributable to your conduct, not our fault. We will give reasonably prompt notice and an opportunity to participate in the defense; no settlement imposing obligations on you will be accepted without your reasonable consent. This clause does not impose an indemnity where consumer law prohibits it.

11. Ending use and changes

You may stop using Inscrybe at any time. Export what you need before deleting local or cloud content. Deleting the app does not cancel an active subscription or erase copies held by others. We may terminate the app license for a material breach, subject to applicable notice and remedy requirements. We do not claim a general right to remotely erase your local library.

We may revise these Terms as the app changes. The date above identifies the version. Material changes will receive notice and any consent opportunity required by law; they do not retroactively remove accrued rights. Ownership, payment obligations already incurred, and enforceable liability and dispute provisions survive termination.

12. Applicable law, Apple and contact

Puerto Rico law governs these Terms, except that you retain mandatory protections and rights to bring claims in courts provided by the law of your habitual residence. Nothing requires arbitration or waives a right that cannot lawfully be waived. Please contact us first if a problem arises so we can try to resolve it.

Your acquisition and use of the app are also subject to Apple’s applicable store terms and the Apple Standard End User License Agreement where applicable. These Terms supplement, and do not purport to replace, that license. Apple is not the provider of Inscrybe’s support or a party to these additional Terms. Nothing here removes rights Apple has under its applicable agreements.

If a provision is unenforceable, the remaining provisions apply to the extent lawful. Failure to enforce a provision is not a waiver. English and Spanish versions are provided; mandatory local-language and consumer protections prevail over any inconsistency.
