1. Acceptance of Terms

Welcome to Unworried ("the App"), developed and operated by Believe PR, owned by Armando Jimenez. By downloading, installing, accessing, or using the App, you ("User," "you," or "your") agree to be bound by these Terms and Conditions ("Terms").

1.1 Agreement to Terms

These Terms constitute a legally binding agreement between you and Believe PR. By using the App, you represent that:

• You are at least 13 years of age (or the minimum age required in your jurisdiction)
• You have the legal capacity to enter into these Terms
• If you are under 18, you have obtained parental or guardian consent
• You will comply with all applicable laws and regulations

2. App Description

2.1 Purpose

Unworried is a wellness application designed to help users build the personality trait of being cool under pressure. The App allows you to:

• Describe situations that are causing you worry or stress
• Receive AI-generated fresh perspectives to help shift your thinking
• Build a journal of perspectives for reflection
• Track daily streaks to build a consistent practice
• Save favorite perspectives for quick access
• Share perspectives with others
• Export your journal as CSV

2.2 Key Features

• Perspective Generation: AI-powered fresh perspectives on your situations
• Journal: Browse and reflect on past perspectives
• Streaks: Daily activity tracking to build consistency
• Favorites: Save and revisit meaningful perspectives
• Sharing: Share perspectives via native share sheet
• Export: Export your journal data as CSV
• Local Storage: All data stored privately on your device
• Bilingual: Available in English and Spanish

2.3 Availability

• The App is available for iOS and Android devices
• Certain features may vary by platform
• An internet connection is required for AI perspective generation
• We reserve the right to modify or discontinue features at any time

3. License to Use

3.1 License Grant

Subject to your compliance with these Terms, Believe PR grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on devices you own or control
• Access and use the App for personal, non-commercial purposes
• Use all features and functionalities as intended

3.2 License Restrictions

You may NOT:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove or modify any copyright, trademark, or proprietary notices
• Rent, lease, lend, sell, or sublicense the App
• Use the App for any commercial purpose without written permission
• Circumvent any security features or access restrictions
• Use automated tools to access or interact with the App

3.3 Ownership

The App and all intellectual property rights remain the exclusive property of Believe PR and Armando Jimenez. This license does not grant you any ownership rights.

4. User Obligations

4.1 Responsible Use

You agree to:

• Use the App in accordance with these Terms and applicable laws
• Understand that the App is for personal wellness and self-reflection
• Keep your device secure and protect your saved data
• Not use the App for any unlawful or harmful purposes
• Understand that AI perspectives are not professional advice

4.2 Data Security

Although the App does not require user accounts:

• You are responsible for securing your device
• Protect your journal entries from unauthorized access
• Back up your data by exporting before deleting the app

4.3 Prohibited Conduct

You agree NOT to:

• Use the App to self-harm or harm others
• Share or distribute the App outside of official app stores
• Attempt to gain unauthorized access to App features
• Interfere with the proper functioning of the App
• Upload malware or malicious code
• Attempt to abuse the AI system with harmful content

5. AI-Generated Content

5.1 Nature of AI Content

Unworried uses Google Gemini AI (via Firebase AI) to generate perspectives. You acknowledge and agree that:

• AI-generated perspectives are created by artificial intelligence, not human professionals
• Perspectives may vary in quality, relevance, and accuracy
• The same situation may generate different perspectives each time
• AI content is provided "as is" without any guarantee of usefulness

5.2 Limitations of AI

AI-generated content:

• May not always be accurate or applicable to your specific situation
• Should not be relied upon as the sole source of guidance
• May occasionally contain errors or inappropriate responses despite content filtering
• Is not a substitute for human judgment or professional advice

5.3 Content Responsibility

You are responsible for:

• Evaluating AI perspectives critically
• Using your own judgment when applying perspectives
• Not relying solely on AI for important life decisions
• Seeking professional help when needed

6. Mental Health Disclaimer

6.1 Not Medical Advice

The App does NOT provide:

• Medical diagnosis or treatment
• Mental health therapy or counseling
• Professional psychological assessment
• Crisis intervention services
• Medical advice of any kind

6.2 Not a Substitute for Professional Care

Unworried is designed for:

• ✓ Personal self-reflection and reframing
• ✓ Building emotional resilience through perspective shifts
• ✓ Journaling and tracking personal growth
• ✓ Complementing (not replacing) professional care

NOT designed for:

• ✗ Diagnosing mental health conditions
• ✗ Treating depression, anxiety, or other disorders
• ✗ Providing therapy or counseling
• ✗ Managing mental health crises

6.3 Seeking Professional Help

6.4 Your Responsibility

You acknowledge and agree that:

• You are responsible for your own mental wellbeing
• You should seek professional help for mental health concerns
• The App is just a tool for self-reflection, not a treatment
• You should not rely solely on the App for mental health management
• You should consult licensed mental health professionals for advice

7. Intellectual Property

7.1 Ownership

All intellectual property rights in and to the App, including but not limited to:

• Source code and software
• User interface and design
• Graphics, logos, and icons
• Text, content, and documentation
• AI prompts and system design
• Trademarks and brand names

...are owned exclusively by Believe PR and Armando Jimenez.

7.2 Trademarks

"Unworried" and associated logos are trademarks of Believe PR. You may not use these marks without prior written permission.

7.3 User Content

You retain ownership of:

• Situation text you enter into the App
• Your journal entries and favorites
• Exported CSV data

Since this data is stored locally on your device and never persistently stored on our servers, we claim no ownership or rights to your content.

7.4 AI-Generated Content

AI-generated perspectives are created using Google's Gemini AI. You are free to use, share, and export these perspectives for personal purposes. We make no claims of copyright over AI-generated text.

8. Prohibited Uses

You agree NOT to use the App for:

8.1 Harmful Activities

• Self-harm or planning self-harm
• Harming others or planning harm to others
• Any illegal activity
• Distributing harmful or inappropriate content

8.2 Unauthorized Access

• Hacking or cracking the App
• Bypassing security measures
• Accessing restricted features without authorization
• Reverse engineering the App code

8.3 AI Abuse

• Attempting to manipulate the AI to produce harmful content
• Using the AI for purposes other than personal self-reflection
• Systematic extraction of AI responses for commercial use
• Submitting intentionally harmful or abusive content to the AI

8.4 Commercial Exploitation

• Reselling or redistributing the App
• Using the App as part of a commercial service without permission
• Incorporating the App into other products
• Scraping or extracting App content

9. Termination

9.1 Termination by You

You may terminate this agreement at any time by:

• Uninstalling the App from all devices
• Deleting all saved data
• Ceasing all use of the App

9.2 Termination by Us

We reserve the right to:

• Discontinue the App at any time
• Block access if Terms are violated
• Remove the App from app stores
• Disable features or functionality

9.3 Effect of Termination

Upon termination:

• Your license to use the App immediately ends
• You must cease all use of the App
• You should export your data before deleting the App
• Provisions regarding disclaimers, liability, and indemnification survive

10. Disclaimers

10.1 "AS IS" and "AS AVAILABLE"

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY
• UNINTERRUPTED OR ERROR-FREE OPERATION

10.2 No Guarantee of Results

WE DO NOT WARRANT THAT:

• The App will improve your mental health or wellbeing
• AI perspectives will be accurate, helpful, or relevant
• The App will meet your specific requirements
• All features will function perfectly at all times
• Bugs or errors will be corrected

10.3 No Responsibility for Mental Health

WE ARE NOT RESPONSIBLE FOR:

• Mental health decisions made based on App perspectives
• Negative mental health outcomes
• Self-harm or harm to others
• Loss of data or journal entries
• Emotional consequences of using the App

10.4 Third-Party Services

WE ARE NOT RESPONSIBLE FOR:

• Google Firebase AI (Gemini) service availability or responses
• Firebase Crashlytics data collection
• Apple App Store or Google Play Store policies
• Device operating system issues
• Internet connectivity problems

10.5 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of implied warranties. In such jurisdictions, the above exclusions may not apply to you, and you may have additional rights.

11. Limitation of Liability

11.1 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BELIEVE PR, ARMANDO JIMENEZ, OR THEIR AFFILIATES BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• EMOTIONAL DAMAGES OR MENTAL DISTRESS
• LOSS OF PROFITS, REVENUE, OR BUSINESS OPPORTUNITIES
• LOSS OF DATA OR INFORMATION
• PERSONAL INJURY OR PROPERTY DAMAGE
• MENTAL HEALTH-RELATED DAMAGES

11.2 Cap on Liability

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED $50 USD (or equivalent in your local currency).

11.3 Basis of the Bargain

These limitations reflect the allocation of risk between the parties. The App is offered as a free wellness tool, not a medical service, and the limitations are an essential basis of the agreement.

11.4 Jurisdictional Exceptions

Some jurisdictions do not allow limitations on liability for certain types of damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

12. Indemnification

12.1 Your Indemnification

You agree to indemnify, defend, and hold harmless Believe PR, Armando Jimenez, and their affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Your violation of any third-party rights
• Any mental health decisions based on the App
• Any harm to yourself or others

12.2 Defense of Claims

We reserve the right to:

• Assume exclusive defense and control of any matter subject to indemnification
• Cooperate with you in defending such claims
• Settle claims at our discretion

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Puerto Rico, without regard to its conflict of law provisions.

13.2 Jurisdiction

You agree that any legal action or proceeding arising from these Terms shall be brought exclusively in the courts of Puerto Rico, and you consent to the jurisdiction of such courts.

13.3 Dispute Resolution

Before filing any legal action, you agree to attempt to resolve disputes through:

• Good Faith Discussion: Allow 30 days for resolution attempts
• Mediation: Consider voluntary mediation if informal resolution fails

13.4 Class Action Waiver

TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE SHALL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION.

13.5 Consumer Rights

Nothing in these Terms limits your statutory rights as a consumer under applicable consumer protection laws.

14. Changes to Terms

14.1 Right to Modify

We reserve the right to modify these Terms at any time. Changes may be made to reflect:

• Business practices changes
• User feedback and concerns

14.2 Notice of Changes

When we make significant changes:

14.3 Acceptance of Changes

By continuing to use the App after changes are posted:
